Terms and Conditions

By accessing barefootbuild.com or engaging Barefoot Build for website services, hosting, Google Business Profile services, or ongoing care plans, you agree to these Terms & Conditions. References to “we,” “us,” or “our” mean Barefoot Build. References to “you” or “client” mean the individual or business receiving services.
If you do not agree to these terms, please do not use our website or services.
1. Service Scope
Barefoot Build provides website design, website development, website refresh services, managed hosting, Google Business Profile services, and ongoing website Care Plans.
We primarily work on WordPress and may migrate existing websites to WordPress when applicable.
All services, timelines, and deliverables are defined in writing before work begins. Any work outside the agreed scope requires written approval and may incur additional fees.
2. Managed Website Hosting
Managed hosting is included with active Care Plans unless otherwise stated in writing.
Barefoot Build selects and manages the underlying hosting provider to ensure security, performance, and reliability.
While a Care Plan is active, Barefoot Build maintains administrative control over the hosting environment. This includes server access, backups, security configurations, and performance tools.
Clients agree not to independently modify hosting settings or server access unless approved in writing.
3. Care Plans & Automatic Billing
Care Plans are monthly subscription services that include hosting, maintenance, monitoring, updates, and support based on the selected plan.
Care Plan billing begins 30 days after website launch unless otherwise agreed in writing.
By enrolling in a Care Plan, you authorize recurring monthly billing through PayPal or another approved payment processor.
Care Plans remain active month-to-month until canceled in writing.
4. Payment Terms
Project-based services such as website builds or redesigns must be paid in full before final launch unless a PayPal Pay in 4 option is used. When Pay in 4 is selected, the PayPal payment agreement serves as both the initial and final deposit, and website launch is not dependent on the completion of all installment payments.
Websites will not be published or transferred to a live domain until the final balance is received.
Care Plan invoices are due immediately upon receipt. The due date is clearly listed on each PayPal invoice under the “Issued” and “Due by” fields.
Failure to review an invoice does not waive payment responsibility.
5. Late Payment Policy for Care Plans
For active Care Plan clients:
- Payment is due on the invoice due date provided
- Days 1–4 after the due date are considered a grace period
- On Day 5, a $25 late fee is applied
- On Day 10, services will be temporarily paused including hosting, updates, and support. Once payment is received, services resume within 24 hours
- On Day 30 of nonpayment, the Care Plan is considered terminated unless other arrangements have been agreed to in writing. Reactivation after termination may require a re-onboarding or restoration fee of up to $99 depending on the lapse period and website condition.
This policy exists because Barefoot Build remains responsible for hosting, uptime, and security during active Care Plans. If at any point you need to change your billing due date, please contact Barefoot Build immediately.
6. Google Business Profile Services
Barefoot Build may assist with Google Business Profile setup, optimization, updates, and guidance.
We do not guarantee approval, reinstatement, ranking, or visibility results.
Google Business Profiles are governed by Google’s policies, systems, and review processes which are outside our control.
Clients are responsible for providing accurate business information and maintaining compliance with Google’s guidelines.
7. Client Responsibilities
Clients agree to:
- Provide accurate and complete information needed to perform services
- Supply required content in a timely manner
- Review and approve content before launch or publishing
- Communicate changes clearly and in writing
- Barefoot Build is not responsible for errors caused by third-party tools, plugins, platforms, or client edits made after approval or launch.
8. Intellectual Property
All custom design work, layouts, and development created by Barefoot Build remain our property until full payment is received.
Once paid in full, clients receive usage rights for the completed website as outlined in the agreed scope.
Barefoot Build retains the right to display completed work in portfolios, case studies, and marketing materials unless a written non-disclosure agreement is in place.
9. Results & SEO Disclaimer
Barefoot Build follows current best practices for SEO, performance, and accessibility within the scope of each service or plan.
We do not guarantee specific rankings, traffic levels, lead volume, or conversion results.
Search engine behavior is controlled by third-party platforms and algorithms beyond our control.
10. Limitation of Liability
Barefoot Build is not liable for:
- Indirect or consequential damages
- Downtime or access loss due to unpaid invoices
- Client-initiated changes or third-party edits
- Platform outages outside our control
- Total liability shall not exceed the amount paid to Barefoot Build in the prior three months of service.
- 11. Termination of Services
- Barefoot Build may pause or terminate services for:
- Nonpayment
- Repeated misuse of support or communication channels
- Attempts to bypass hosting management or security controls
Upon termination, website files or migration assistance may be provided for an additional fee if requested.
12. Governing Law
These Terms & Conditions are governed by the laws of the State of North Carolina.
