Welcome to Barefoot Build.
By accessing or using our website (barefootbuild.com) or entering into a project, service, or maintenance agreement with Barefoot Build (referred to as “we,” “us,” or “our”), you agree to be bound by these Terms & Conditions.
If you do not agree, please do not use our site or services.
1. Service Scope
Barefoot Build provides custom web design, web development, website refresh services, and ongoing website care plans that include managed hosting, maintenance, security, performance monitoring, and content updates (as outlined in advance per individual plan).
We primarily work on WordPress.
All project details, scope of work, and deliverables are defined in writing before project begin.
2. Website Hosting Management
Barefoot Build manages hosting on behalf of clients as part of our Care Plans.
We reserve the right to choose and manage the underlying server provider used for hosting services.
Clients agree that Barefoot Build controls access and administration to the hosting environment during the term of service.
3. Payment Terms
Project-based work (such as website builds or redesigns) must be paid in full before final launch.
A site will not be published until the final balance has been received.
Invoices for Care Plans (monthly subscription services) are due immediately upon receipt, with the due date visible at the top of each PayPal invoice.
To confirm due dates inside PayPal, click the invoice and the “Issued” and “Due by” dates are clearly listed.
4. Late Payment Policy for Care Plans
For active monthly Care Plan clients:
Payment is due on the date stated on the PayPal invoice
- Days 1–4 following the due date are considered a grace period
- On Day 5, a $25 late fee is applied
- On Day 10, website services may be temporarily paused including hosting access, support, and updates
Once payment is received, services resume within 24 hours
On Day 30 of nonpayment, the Care Plan contract is considered terminated unless other arrangements have been discussed and agreed upon in writing
If a Care Plan is terminated, future reactivation may require a re-onboarding or restoration fee depending on the website’s condition and lapse period.
This policy exists because we manage and are responsible for ongoing hosting access, security, and uptime.
5. Client Responsibilities
Clients agree to:
- provide accurate information and content required for work
- confirm final content before launch or publishing
- review and approve content before posting (including blogs if applicable)
Barefoot Build is not responsible for correcting third-party errors introduced after launch or after client edits.
6. Intellectual Property
All original custom design work produced by Barefoot Build remains ours until full payment is received.
After full payment, the client receives usage rights for completed site assets as outlined in project scope.
Barefoot Build maintains rights to use screenshots, mock-ups, or launched websites for portfolio and marketing purposes unless a written NDA is in place.
7. Results & SEO Disclaimer
Barefoot Build follows best practices for SEO within the scope of each project or plan.
However, we cannot guarantee:
- specific ranking results
- traffic volume increases
- conversion outcomes
Search engine behavior is determined by third-party algorithms outside our control.
8. Limitation of Liability
Barefoot Build is not liable for:
- lost revenue
- indirect or consequential damages
- loss of access due to unpaid invoices per the above policy
- client-side errors or edits made by third parties
9. Termination
Barefoot Build may pause or terminate service if:
- payments are not made
- repeated abuse of communication or support channels occurs
- client attempts to bypass hosting management or access areas we are legally responsible for maintaining
Upon termination, Barefoot Build may provide export files or transfer support for a fee.
10. Governing Law
These Terms & Conditions are governed in accordance with the laws of North Carolina, USA.
